WILL OF HENRY CROASDELL - 1851

This is the last Will and Testament of me Henry Croasdell of Hawthwaite in the Township of Broughton in Furness in the County of Lancaster Farmer as follows - I give and bequeath unto my Son James Croasdell of Hawthwaite aforesaid Farmer All my Wearing apparel - All the residue of my personal Estate and Effects whatsoever and wheresoever I give and bequeath unto the said James Croasdell Anthony Parker of Bootle in the County of Cumberland Farmer, and John Usher of Hawkshead in the said County of Lancaster Inkeeper Upon Trust that they do and shall in the first place immediately after my decease pay unto my dear Wife the Sum of five pounds and in the next place pay and discharge all my just Debts Funeral and Testamentary Expenses and also permit and suffer my said dear wife to have the full use and enjoyment of all my Household Goods and Furniture Plate Linen and China and Things appertaining to Housekeeping during the Term of her natural life And also do and shall pay and thereby give and bequeath unto her during the Term of her natural life one annuity or yearly Sum of fifteen Pounds (being part of a Debt of two hundred Pounds due and payable to me by twenty five Pounds annual instalments by my son John in liquidation of a promissory Note with Interest at four Pounds per Centum per Annum) and to be paid to her by quarterly payments or three Pounds fifteen Shillings each, the first payment to begin and be made at the end of three Calendar Months next after my decease - And as to the remaining ten Pounds (and if my said wife be dead or hereafter die in the life time of my Daughter Elizabeth then as to the whole of the said twenty five Pounds) and the Interest arising from the said promessory Note and any arrears due thereon, pay all or part or none of it, as they my said Trustees or the majority of them shall think proper (who shall be the sole judges herein) for and towards the maintenance and comfort of my said Daughter Elizabeth during the Term of her natural life or until the same shall be exhausted But if my said Trustees or the majority of them shall be of opinion that the said Sum of ten Pounds (or twenty five Pounds as the case may be) and the Interest as aforesaid, or what shall be remaining unpaid of the said Debt of two hundred Pounds and the Interest as aforesaid will be more beneficially retained for the use of my Grandchildren they shall and they are hereby diricted to retain the same accordingly and place it out at Interest, and after the decase of my said Daughter, or before if the majority of my said Trustees shall think proper, but after the decase of my said dear wife, divide and thereby give and bequeath the same, if not exhausted and the Interest as aforesaid and the proceeds arising from the sale of my said Household Goods and Furniture Plate Linen China and things appertaining to Housekeeping unto and equally amongst all my Grandchildren share and share alike on their respectively attaining the age of twenty one years or marriage - I appoint the said James Croasdell Anthony Parker and John Usher Executors hereof and direct that they shall and may by and out of the said trust Monies coming to their hands (after the payment aforesaid to my said dear wife) pay retain to and reimburse themselves all Costs Charges Damages and Expenses and for their loss of time and trouble which they may be put to, in or about the Execution of the Trusts hereof In Witness whereof I have hereunto set my Hand this twenty seventh Day of May one thousand eight hundred and fifty one

This Will was signed and acknowledged by the said Henry Croasdell the Testator in the Presence

of us who were present at the same time and have attested and subscribed the same in the Presence of the said Testator and of each other

On the nineteenth day of November in the year of our Lord one thousand eight hundred and fifty one this Will of Henry Croasdell late of Hawthwaite in the parish of Kirkby Ireleth in the County of Lancaster within the ARchdeaconry of Richmond in the Diocese of Chester, Farmer, who departed this Life on or about the fourteenth Day of July one thousand eight hundred and fifty one was proved in common form and James Croasdell of Hawthwaite in the Parish of Kirkby Ireleth in the County of Lancaster, one of the Executors therein named was sworn well and faithfully to execute and perform the same and so forth (Power being reserved for Anthony Parker of Bootle in the County of Cumberland and John Usher of Hawkshead in the County of Lancaster, the other Executors therein named, and so forth) and that according to the best of the Knowledge Information and Belief of the said John (sic) Croasdell the said Executor, the whole of the Goods Chattels and Credits of which the Testator Henry Croasdell died possessed within the Archdeaconry of Richmond in the Diocese of Chester (exclusive of what the said Testator might have been possessed of or entitled to as a Trustee for any other Person or Persons and not beneficially and without deducting anything on account of the Debts due and owing by and from the said Testator) were under the value of Two Hundred Pounds
